Terms, payments & refunds

These terms explain how we work with you. We've kept them short and in plain English. Escarpment Web Co is a registered business name of Heath Elliott Taylor Jacquin (ABN 96 674 874 587), a sole trader based in Keiraville, NSW ("we", "us").

1. Free previews

We may build a preview website for your business using publicly available information, such as your business name, services, hours and address. A preview is free, it's clearly marked as a preview, and it's hidden from search engines. If you don't want it, tell us and we'll take it down. Otherwise we remove any preview that isn't taken up within 30 days.

2. Website build ($249)

• You review the preview and ask for any changes before launch. We make reasonable edits until you're happy.
• You pay the build fee only once you approve the site. We then put it live on your domain.
• The build covers a site of 1–4 pages. Bigger jobs and extras are quoted upfront before any work starts.

3. Care plans ($39 or $69 per month)

• Care plans are optional and billed monthly in advance by card through our payment provider, Stripe.
• They're month to month with no minimum term. Cancel any time by emailing us, and you won't be charged again. Your plan keeps running until the end of the month you've paid for.
• "Small updates" means changes like hours, prices, menu items, text and photos. New pages or new features are quoted as extras.

4. Refunds

• Because you see and approve the finished site before paying, the build fee isn't refundable once the site is live, unless we haven't delivered what we agreed.
• Care plan payments already made for the current month aren't refunded when you cancel, but you won't be charged for any later month.
• If something we promised isn't delivered, email us and we'll fix it or refund you fairly.
• Nothing in these terms limits your rights under the Australian Consumer Law. Our services come with guarantees that can't be excluded under that law.

5. What you own

Your domain name is registered in your name. Once the build fee is paid, the website design and content made for you are yours to use. If you leave, we'll hand over the site files so anyone can host them.

6. Your responsibilities

• Check that the details on your site (prices, hours, services) are correct before launch, and tell us when they change.
• Only send us photos, logos and text you have the right to use.
• Pay for your own domain renewal (usually around $20–30 a year). We'll remind you before it's due.

7. Our responsibilities

We'll do the work with reasonable care and skill, and keep your site secure and online as best we can. Hosting providers occasionally have outages that are outside our control. We're not responsible for business lost during an outage we couldn't reasonably prevent, except where the Australian Consumer Law says otherwise.

Our services are supplied to businesses. To the extent the law allows, if we fail to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again. We're not liable for indirect losses, such as lost profits or lost business, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

You're responsible for checking that the information on your site is accurate before it goes live, including prices, hours, services and any claims about your business.
